Special counsel Jack Smith resigns after 2-year stint at Department of Justice

By Andrea Margolis | Fox News Special counsel Jack Smith resigned from his position at the Department of Justice Friday, Fox News has learned. The resignation, which had already been expected since President-elect Trump was elected in November, was quietly announced in the footnote of a court filing Saturday.  "The Special Counsel completed his work and submitted his final confidential report on January 7, 2025, and separated from the Department on January 10," the note said. Justice Department says it plans to release only part of special counsel’s Trump report for now

By The Associated Press, via Breitbart The Justice Department said Wednesday that it will release special counsel Jack Smith’s findings on Donald Trump’s efforts to undo the results of the 2020 presidential election but will keep under wraps for now the rest of the report focused on the president-elect’s hoarding of classified documents at his Mar-a-Lago estate. The revelation was made in a filing to a federal appeals court that was considering a defense request to block the release of the two-volume report while charges remain pending against two Trump co-defendants in the Florida case accusing the Republican former president and current president-elect of illegally holding classified documents. Aileen Cannon, the Trump-appointed judge presiding ov...

Fani Willis ordered to give watchdog all communications with special counsel Jack Smith

By Greg Wehner  | Fox News A Georgia judge ordered Fulton County District Attorney Fani Williams to hand over records related to her communications with special counsel Jack Smith and the U.S. House January 6 Committee after failing to comply with a request under the Open Records Act (ORA). The nonprofit group Judicial Watch filed a lawsuit against Willis in March after her office claimed it did not have any documents and communications on file between Willis and Smith or Willis and the January 6th Committee. But it turned out her office did have communications, and on Monday, Fulton County Superior Court Judge Robert McBurney ordered Willis to produce them within five business days. McBurney also determined in his ruling that Willis violated Georgia’s open records act b...

Special counsel Jack Smith seeks to dismiss Trump’s January 6 case

By Haley Strack | National Review Biden-Harris Justice Department special counsel Jack Smith filed a motion Monday to dismiss all felony charges against President-elect Donald Trump in relation to the January 6 election-interference case. Trump was accused of interfering in the 2020 election and was indicted in August 2023 on multiple charges, including conspiracy to defraud the U.S., conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights. On Monday, Smith petitioned U.S. District Judge Tanya S. Chutkan, who is presiding over the case, to dismiss the case  in accordance with the DOJ’s policy to not prosecute sitting presidents. Judge Chutkan grants Jack Smith’s request to cancel further proceedings in January 6 case

By Andrew C. McCarthy | National Review Federal lawfare is indeed winding down, as we discussed earlier this week. Judge Tanya Chutkan, the Obama appointee who is presiding over the 2020 election interference case against President-elect Trump, issued a brief order on the docket today, vacating all proceedings scheduled in the case, including any briefing on pending issues. She ordered that on or before December 2, 2024, Biden-Harris DOJ special counsel Jack Smith must file “a status report indicating [the government’s] proposed course for this case going forward.” The course for the case is to dismiss it. Judge Chutkan’s order was a result of a brief application by Smith’s staff, unopposed (naturally) by Trump’s counsel, stating: READ THE FULL STORY AT NATIONAL REVIEW...

Corrupt special counsel Jack Smith to exit DOJ, drop cases

By John Nolte | Breitbart Corrupt Special Counsel Jack Smith, the Keystone Cop who has serially failed to throw Donald Trump in prison or undermine his reelection chances, will not wait for incoming President-elect Trump to fire him (as Trump has understandably promised to do). Instead, since a special counsel cannot prosecute a sitting president, Smith will leave the Department of Justice before Trump is sworn in as the 47th president. The (phony) cases against Trump will also be dropped. Here’s the Fox News report: Since November 2022, Smith has sought to put Trump in prison using four felony accounts that laughably claim Trump conspired to steal the 2020 presidential election. By Julia Johnson , Jake Gibson | Fox News The judge in former President Donald Trump's federal election interference case ordered more documents to be revealed from special counsel Jack Smith's investigation into the former president just weeks before the 2024 election.  U.S. District Judge Tanya Chutkan ordered on Thursday night that additional documents be made public.  The documents pertain to the appendix of exhibits in the fight over whether Trump has a level of presidential immunity that negates the charges against him.  READ THE FULL STORY AT FOX NEWS

Jack Smith lays out 2020 election case against Trump in newly unsealed filing

By Kaelan Deese | Washington Examiner Special counsel Jack Smith on Wednesday provided additional details on former President Donald Trump’s alleged efforts to overturn the 2020 presidential election, offering a plan to disprove what he called Trump’s “false claims” about election fraud and fight against the Supreme Court’s immunity decision. The 165-page motion, unsealed Wednesday by U.S. District Judge Tanya Chutkan, includes new revelations about plans by a Trump campaign employee and alleged co-conspirator to incite chaos at a ballot-processing center in Detroit. According to one section of the lengthy filing, a 2020 Trump campaign employee allegedly aimed to disrupt operations at Detroit’s TCF Center, a key site for vote counting in Michigan. Trump trial stemming from Jack Smith’s probe delayed past Election Day

By Paul Bois | Fox News Federal Judge Tanya Chutkan will not hold the trial for former President Trump on charges stemming from Special Counsel Jack Smith's Jan. 6 investigation until after the 2024 presidential election.  Chutkan held a status hearing Thursday morning in U.S. District Court for the District of Columbia, in which lawyers for Trump pleaded not guilty on his behalf related to charges from Smith’s new indictment after the Supreme Court ruled a president is immune from prosecution for official acts in office. Special council Jack Smith springs another indictment on Trump

By Fred Lucas | Daily Signal In an attempt to salvage his prosecution against Donald Trump, special counsel Jack Smith secured a reindictment Tuesday against the 45th president on four felony charges in his Washington, D.C., election interference case.  The case revolves around Trump’s various challenges to the 2020 election outcome, most notably his effort to prevent Congress from certifying Joe Biden’s Electoral College victory on Jan. 6, 2021. The Washington federal grand jury’s new 36-page indictment is similar to the previous indictment in the case. However, in early July, the U.S. Supreme Court determined Trump had immunity for actions taken in his official capacity as president. The new indictment is Smith’s attempt to recast his case in light of the court’s ...
