By Rebecca Boone | AP via KDVR A federal judge says President Donald Trump can use the Alien Enemies Act to deport Venezuelan citizens who are shown to be members of the Tren de Aragua gang. The ruling Tuesday from U.S. District Judge Stephanie Haines in Pennsylvania appears to be the first time a federal judge has signed off on Trump’s proclamation calling Tren de Aragua a foreign terrorist organization and invoking the 18th century wartime law to deport people labeled as being members of the gang. Supreme Court orders temporary halt to deportation of Venezuelans under Alien Enemies Act

McCarthy | National Review The Supreme Court acted Friday night to block the Trump administration from deporting Venezuelan aliens held in Texas whom the administration claims are members of Tren de Aragua (TdA) and, hence, argues are removable under the president’s Alien Enemies Act (AEA) proclamation. Justices Clarence Thomas and Samuel Alito dissented from the Court’s one-paragraph order. The Court indicated that Justice Alito is writing on the matter and we can expect him to issue an opinion shortly. Brambila | Denver Gazette The American Civil Liberties Union has filed a lawsuit in U.S. District Court in Colorado to try to block the Trump administration from using the Alien Enemies Act to remove immigrants unlawfully living in the U.S. who are accused of being members of a Venezuelan gang. The lawsuit seeks a temporary restraining order to prevent President Donald Trump from using the wartime act, arguing the White House proclamation designating members of Tren de Aragua as "alien enemies" does not satisfy the tenets of the Alien Enemies Act. By Elizabeth Weibel | Breitbart The Supreme Court of the United States lifted a block from U.S. District Judges James Boasberg, which prevented the Trump administration from deporting suspected illegal alien gang members under the 1798 Alien Enemies Act. While the ruling from the Supreme Court is a win for President Donald Trump and his administration, it was described as “narrow and focused on the proper venue for the cases, rather than on the administration’s use of a centuries-old law to justify its decision” to deport suspected illegal alien gang members, according to the New York Times.
